My Letter to Senator Murray

Dear Senator Murray,

I am writing you because I am shocked and deeply disturbed by your incomprehensible vote to confirm the nomination of General Michael Hayden as the new Director of the CIA.

I believe your constituents deserve an explanation as to why you could not see the uniform on the man who will lead this civilian agency at a time when each and every one us has become a suspect in the Bush Administration's search for terrorists. My I remind you that he is the same man who denied that the 4th Amendment to the Constitution included a requirement for a warrant.

I look forward to your reply.

State Supreme Court Races

Our Supreme Court will likely be looking at issues like election reform, redistricting, same sex marriage, Real ID implementation, death penalty, and Hanford clean up over the coming months and years. After Rossi v Gregoire the Right decided to target our Supreme Court and even though this race is non partisan we Democratic PCOs have an obligation to become informed of theses issues, candidates, and the potential effect on us.

Jurisdiction
The Supreme Court is the state's highest court. Its opinions are published, become the law of the state, and set precedent for subsequent cases decided in Washington.
The Court has original jurisdiction of petitions against state officers and can review decisions of lower courts if the case involves a question of the legality of a tax, duty, assessment, toll, or municipal fine, or the validity of a statute.
Direct Supreme Court review of a trial court decision is permitted if the action involves a state officer, a trial court has ruled a statute or ordinance unconstitutional, conflicting statutes or rules of law are involved, or the issue is of broad public interest and requires a prompt and ultimate determination. All cases in which the death penalty has been imposed are reviewed directly by the Supreme Court.
Motions to be determined by the Court, and petitions for review of Court of Appeals decisions, are heard by five-member departments of the Court. A less-than-unanimous vote on a petition requires that the entire court consider the matter.
The Supreme Court is the final rule-making authority for all of the state's courts. Though local courts make their own rules of procedure, these rules must conform to those established by the Supreme Court. In addition, the Supreme Court has administrative responsibility for operation of the state court system.

Justices
The nine Supreme Court justices are elected to six-year terms. Each term is staggered to maintain continuity of the court. Vacancies are filled by appointment of the Governor until the next general election.

Current justices up for election in 2006 are:

* Gerry L. Alexander, Chief Justice
* Tom Chambers, Justice
* Susan J. Owens, Justice

Chief Justice Gerry L. Alexander. Gerry Alexander was first elected to a seat on
the Washington Supreme Court in 1994. In 2000, Justice Chambers was elected to the Washington State Supreme Court. On November 7, 2000, Judge Susan Owens was elected the seventh woman to serve on the Washington State Supreme Court.

Candidates
John M. Groen is challenging Gerry Alexander. Currently no new candidates have yet declared that they are targeting Judges Owen and Chambers. However, Brent D. Boger and Stephen L. Johnson are registered with the Public Disclosure Commission and are raising money to run for the Supreme Court – they just haven’t announced which positions.

Funding & PACs
A group called FAIRPAC registered on April 25th with the state as a PAC, or political action committee. FAIRPAC is going to raise money on behalf of judicial candidates Owens, Chambers, Alexander.

The arrival of FAIRPAC is good news because another PAC, the Constitutional Law PAC, has been registered since late last year. They currently only have about $4,600 in their treasury but their mission is to fund a slate of conservative judges to take out Owens, Chambers, and Alexander and they are currently actively fund raising.

A quick cross reference of Con Law PAC’s contributors shows nearly 90% overlap with donors to the James Johnson campaign—a business-friendly conservative Supreme Court candidate who took out the more liberal Mary Kay Becker in 2004. Former GOP Senator Slade Gorton is Con Law PAC’s chairman.

While there are contribution limits on judicial races in Washington state ($1400 per contributor), there are no limits on donating to PACs. That makes Con Law PAC a threatening force. According to the PI:

“Johnson was elected in 2004 with the help of more than $200,000 in campaign contributions from the Building Industry Association of Washington and its affiliates…Johnson’s BIAW money alone dwarfed the entire campaign treasury of his opponent, Mary Kay Becker.”

Mary Kay Becker raised just $157,000 in 2004 to James Johnson’s $539,000.

I’ll watch the money and donors and keep you posted as to what I discover but each of us must commit to becoming aware of the issues and the candidates to the Supreme Court. These could be the 3 most important races we’ll follow this year.

Various sections of 434 WAC (Washington's Administrative Code) are being updated to set the details on how we will replacing punch cards in WA -- and how we will implement the voter-verified paper trail audits that state law now requires when digital recording devices are utilized.

Here's what the notice of the public hearing lists as the topics of the day:

- Voters leaving the polling place without voting

- Storing ballot images

- Resolving ballots tabulated on digital scan devices

- Voting system requirements

Mike 'Safeco' McGavick

Just what we DON'T need -- our own bought-and-paid-for Senator!!

From WA State Democrats press release:

Safeco Insurance released their annual proxy statement describing in detail the golden parachute for Lobbyist Mike! McGavick's run for political office.

"Mike McGavick continues to be on the insurance industry payroll while he campaigns full time," said Dwight Pelz, Chair of the Washington State Democrats. "He has received millions of dollars in benefits since he announced his candidacy in August, started campaigning and fundraising in September, and then toured the state soliciting votes. Just whose side is he going to be on in the Senate: Washington families or the insurance industry that is paying him to run?"

Among the standouts in McGavick's special deal is over $1.3 million in deferred compensation this year, while he is no longer an employee and while he campaigns for federal office, on top of a $2.3 million bonus awarded just last month.

The report also describes McGavick's special deal worth $3 to 4 million in stock options, which he signed with the insurance company in December after announcing his Senate bid. Moving up the vesting date meant McGavick could rake in additional profits before leaving insurance company payroll.

Lobbyist Mike! McGavick's golden parachute compensation for 2005 and 2006 includes:

· A $2,314,180 bonus awarded on February 15, 2006, months after he had already started campaigning.
· Another $1.1 million bonus in the form of "performance stock rights" awarded on December 31, 2005.
· Stock option changes worth $3.3-4.5 million (depending on the day's stock price). These are the 210,000 stock options, the vesting of which was accelerated to his last day with the company (2/28/06).
· $1.3 million in deferred compensation that McGavick will get as a lump sum payment in 2006.
· Becoming eligible (in late January) just before leaving for a $50,000 a year "cash balance" plan (a form of a pension).

Still Trying to Get Co-Sponsors

Sen Cantwell's staff sent me one of her feel-good e-mails so I took the opportunity to again express my wish that she co-sponsor Feingold's censure resolution:

Thanks for the up date on what Senator Cantwell is doing. Senator Cantwell does a fine job supporting our troops and I especially appreciate her leadership on fighting the good fight against drilling in ANWAR-- but we NEED her to show leadership on protecting our Constitution. We know through recent freedom of information requests that this administration has classified Quaker groups,"tea and cookie"-church-basement-type peace groups, and organizations like PAWS as "terrorist". So when President Bush says he's only wiretapping without a warrant "terrorists", I'm worried.

Please tell the Senator that we need her to stand upfor the 4th Amendment. Warrants and oversight are a critical and essential part of what differentiates us and makes us secure and free.

PLEASE CO-SPONSOR THE FEINGOLD CENSURE RESOLUTION.

My Letter to Senators Murray and Cantwell

Please sign on as a co-sponsor to Senator Russ Feingold's censure resolution (http://www.dailykos.com/story/2006/3/12/10579/0414 ).
  • The President admitted to conducting a domestic spying program outside the scope of FISA, despite knowing that FISA is the exclusive means of such surveillance inside the United States.
  • President Bush broke the law, and this is the only way this Republican Congess can hold him accountable.
  • President admitted he did not brief the full intelligence committees. This is against the law.
    We don't have to wait for an investigation before censure.
  • President Bush admitted to his crimes publicly. An investigation is needed, but that should not preclude censure at this time.
  • Andrew Jackson was censured in 1834 for refusing to hand over papers to Congress and assuming power not granted by the Constitution. With his stonewalling of the investigation and by ignoring FISA, this is exactly what President Bush has done, and he should also be censured accordingly.


Please stand up and be counted.
